A TEACHER convicted of assaulting pupils has been given an out-of-court settlement by his former council employers.

Mike Barile, 52, was due to take Dundee City Council to an unfair dismissal tribunal after appeal judges ruled him to be the victim of "disgraceful behaviour" by the youngsters.

He lost his job in December 2008 after being convicted of two assault charges involving
male pupils

However, just hours before his tribunal was due to open, the council struck a deal with Mr Barile in return for his silence.

It is understood the council feared the former maths teacher would embarrass the authority. The hearing was due to run for at least five days and Mr Barile was expected to give evidence on teaching standards and conditions.

However, yesterday, Mr Barile's solicitor confirmed a deal had been struck. John Muir, of Dundee law firm Muir, Myles, Laverty, said: "My client has settled out of court and I am unable to say anything more."

Mr Barile had taught in schools in Fife and Dundee for 25 years before the incident that ended his career. The original trial at Dundee Sheriff Court heard the maths teacher lost patience after pupils told him to "f*** off" and called him a "walking penis".

The father of two was found guilty of grabbing a 15-year-old boy's shirt, pushing him and threatening to put him "through the blackboard".

He was also found guilty of placing his arm across the boy's chest and preventing him from leaving the classroom at Lawside Academy in Dundee.

However, Mr Barile launched a legal bid to clear his name after he and his wife were hit with eggs and their house attacked.

In November last year, three judges sitting at the Appeal Court in Edinburgh dismissed the appeal but criticised prosecutors for bringing a criminal case against the teacher.

They said that it was not in the public interest, given the boys' "disgraceful behaviour" and the "relatively insignificant nature" of Mr Barile's response.

However, it is not the first time the former teacher has encountered problems. In September 2006, he was assaulted and threatened by a pupil at Madras College in St Andrews, Fife.

After a disciplinary dispute with the Madras rector over his handling of the attack, Mr Barile moved to Lawside Academy in August 2007.

But publicity surrounding his earlier troubles followed him and, within months, Mr Barile had to report violence in the classroom to the rector and Tayside Police. He also discovered that Lawside pupils had set up a smear campaign against him on social networking website Bebo.

At the time, he said: "I came across the Bebo network where I was introduced as a 'paedophile in the maths department'.

"There was also an allegation that I raped a first-year pupil in the toilet. It was ridiculous garbage."

Mr Barile has vowed never to return to teaching and focus instead on his role as fans' representative on the Dundee United FC board.

However, he can expect to be banned from the profession by regulator the General Teaching Council for Scotland.

A Dundee City Council education department spokesman said: "We understand that the employment tribunal case against the council is being withdrawn."

Would it not have been simpler and cheaper for Dundee City Council to have admitted there mistake and given him his job back then any money paid would have been as wages therefore productive, not wasted like Mike Barile skills will be as an ex school teacher.

This is so typical of government/public officials - rather than take it on the chin and admit they haven't got a spec of decency or in the first instance rationale judgement - they splash out our taxes on effectively making Mr Barile go away.

I can imagine the conversation .... "well Mike its the best offer you will get as there is absolutely no prospect of you being offered back your job"

Faced with that and the knowledge his teaching would probably be dogged by other have a go yobs at school - he probably weighed up the best option for himself.

However, DCC should be ashamed of their inept and unfair handling of this whole affair. Why does nothing DCC do surprise me!

The reality is this DCC Education department has cost Dundonians a fortune through their incompetence and bad management. The silence only has bought them more time and further incompetence to emerge. Then again maybe they have learned another valuable lesson. The lesson being they can get away with anything, time and time again!!
I hope Mike has made enough to retire comfortably and maybe write a book. Good luck to him and his endearing wife.

Why the hush money or bribe? Mike has obviously something that DCC don't want made public. He should tell them to get lost and drop a bombshell to the media. His story would probably fetch more in print than he was offered anyway.

Tribunal “better” in Barile assault case

A SENIOR Dundee councillor has said “the air would have been cleared” if a teacher sacked from a city high school after being convicted of assaulting two pupils had not dropped a claim of unfair dismissal.

Ex-Lawside Academy maths teacher Mike Barile (52) reached a settlement with Dundee City Council last week.

However the payout came with a gagging order that means Mr Barile cannot discuss the incident or the award.

Before the tribunal Mr Barile said he was looking forward to being able to discuss pupil discipline and air his grievances against the council and Lawside Academy over their handling of the incident— issues which will now never be made public.

Mr Barile’s sacking sparked a debate about classroom discipline and, after news of his settlement Scotland’s largest teaching union, the Education Institute of Scotland, said school staff should be given greater protection from unruly pupils.

Independent councillor and Deputy Lord Provost Ian Borthwick said yesterday that although he could not comment on the settlement, the tribunal would have allowed concerns about classroom discipline in Dundee to be addressed publicly.

He said, “The agreement was mutual and so I can’t comment on that but it might have been better for matters to take their course and the tribunal to have gone ahead.

“There was so much publicity and so much comment that it would maybe have been better for the air to have been cleared.”

Mr Barile was fired on December 28 after he was found guilty of assaulting a boy by grabbing his shirt and threatening him and assaulting another by placing his arm across his chest to stop him leaving the classroom.

Although Mr Barile was found guilty, he was admonished by Sheriff Charles MacNair so that no fines or other disposals were brought.

Sheriff MacNair also said the charges were of a minor nature and would not have been brought forward if Mr Barile was not a teacher.

Judges threw out an appeal against his conviction, but noted they did not believe his prosecution had been in the public interest.

He will find out today if an appeal against his sentence has been successful.

He wants it downgraded to an absolute discharge to still work with a charity linked to Dundee United.

Mr Borthwick added that, despite this case, it is important not to believe classroom indiscipline is rife in Dundee.

He said, “I think there are dangers in exaggerating the problem but, on the other hand, there are concerns.

“What is important is that teachers and staff are given the fullest support possible.”
